Biletix Purchase Policies and Sales Agreement

As per Article 3 of the Law No. 6563 on the Regulation of Electronic Commerce (“Law”) and the relevant provisions of other related laws and regulations; all the introductory information on Biletix Bilet Dağıtım Basım ve Tic. A.Ş (“Biletix”) is available in the "About Us" section of our website and also set forth in the Preliminary Informatory Text. Our goal, as Biletix, is to ensure that you buy the ticket of the event you intend to attend or participate within the shortest time and in the easiest way possible. We have designed our Sales Policy and Sales Agreement below to satisfy you and inform you about the purchasing process on Biletix.com. We hereby state that the sales made on the website are subject to the distance sales regulations; and laws and the terms of the agreement between the parties are determined within the rules of the distance sales agreement. Since our company discloses the provisions of the sales agreement and the preliminary informatory text to you in accordance with the provisions of the legislation before the conclusion/execution of the agreement, we strongly recommend you to read the Sales Agreement before confirming your ticket purchase order and buying a ticket. Our Sales Policy and Agreement also constitute a part of our Terms and Conditions. We also kindly submit for your information that confirming your ticket purchase order and/or buying ticket via our website, you shall be deemed to have read and understood the Terms and Conditions, Sales Policy and the provisions of the Agreement as well as the Privacy Statement, and you shall be deemed to have accepted their contents thereof; in case you have an otherwise demand or complaint against the provisions of the sales policy and/or the sales agreement, we recommend you to visit the Help page and/or contact us at the contact numbers listed in our website before confirming your purchase order and buying any ticket. We hereby strongly reiterate that buying ticket from our website and confirming your ticket purchase order, you shall be considered to abide the provisions hereof, delivered to you beforehand. Therefore, we strongly remind you that in case you purchase a ticket from our website, the following contractual terms and conditions shall be applicable to the whole process, procedures and transactions with regard to the tickets of the relevant event. Your ticket purchase shall additionally be subject to (i) the special terms and conditions disclosed and announced to be applicable to the event, (ii) all other terms and conditions of the event determined and announced by the event organizer(s) and/or the event's announced terms and conditions, and (iii) the event venue terms and conditions, if announced by the event organizer (including entry requirements) by the way so. Therefore, buying a ticket, you thereby agree that you shall abide by all the terms and conditions determined and announced for the event. If you do not agree with any of the terms and conditions of the event organized and disclosed, or if you cannot and/or will not comply with any of these terms and conditions, you should not purchase a ticket. Otherwise, even if you have purchased a ticket, we significantly emphasize that Biletix shall not be responsible where you are not let in/ forced to leave the event venue and/or event, and Biletix shall not be liable for any payment, including the ticket price either. Furthermore, as also informed to you by the Preliminary Informatory Text, having confirmed your ticket purchase order, you hereby and thereby agree, acknowledge and undertake in writing - before buying the ticket - that you are aware of all the following information: a) all the necessary information and contact addresses about our company, b) all the features of the ticket and service you have purchased, as well as the total ticket/service price including all taxes, and all additional costs, if any, c) information on payment, delivery, performance and legal remedies relating to the complaints set forth in the agreement, d) the contractual information that you can apply to the consumer arbitration committee within the monetary limits published in the relevant legislation or to the consumer court with the condition of applying to the mediator before filing a lawsuit in accordance with Article 73/A of the Law, e) you do not have the right of withdrawal as per Article 15(g) of the Distance Contracts Regulation; consequently, you are aware of all the terms and conditions set forth under the Agreement. We additionally and significantly reiterate that before confirming your ticket purchase order and buying the ticket, the requirement of preliminary information has been fulfilled by the way of providing you with the information as per the related laws and regulations; and the relevant Preliminary Informatory Text is an integral part of this Sales Agreement. In addition, we would like you to significantly know that with this agreement and your preliminary consent, you have clearly and explicitly been informed that you shall be under the obligation to pay if your ticket purchase order is approved".

Terms and Conditions/ Contractual Provisions for Event Ticket Purchase/Sale:

1. Our Company named "Biletix Bilet Dağıtım Basım ve Ticaret A.Ş.” (“Biletix”), as an authorized ticket sales agency, acts as an intermediary for sales and distribution of the event tickets of the “organizers, event venues, clubs or theaters” (hereinafter referred to as the “Event Organizer”) and charges a service fee per ticket, but does not have the right or authority and accordingly responsibility to determine the event content, ticket prices or seating. Our company does not act for on behalf of the event organizers, and does not have any legal/commercial relationship with the organizers under whatsoever title, in terms of any dealership, distributorship, representation, sub-dealership, etc. The person buying the ticket hereby declares and undertakes that he/she has purchased the ticket for his/her personal use only, without any commercial purpose, and that he/she shall not use the ticket for any commercial business or other activity, except with the express written permission of the Event Organizer or its representatives. For instance, the purchased ticket cannot be sold to third parties in any way, the ticket cannot be offered to be sold for an additional fee or in any other way; the purchased ticket cannot be used for promotional or other commercial purposes or illegally, including but not limited to advertising, contests and sweepstakes.

2. Biletix has no knowledge, contribution or involvement of the events and their contents. The Event Organizer determines the maximum number of tickets and prices per person for the events. The number of tickets that can be purchased is indicated in the "Please Note" section on the event page and at the first stage of the ticket purchase. The purpose of this implementation is to prevent unfair ticket purchases. Ticket purchases may be limited in terms of number of persons and/or per credit card for some events and per household for others. In case of detection by us that this rule is violated in any way, Biletix reserves the right to unilaterally cancel the tickets purchased over the specified number limit, whether by using more than one card or by using the cards of the members of the same household. It is strictly forbidden to purchase tickets through the use of automatic means.

3. Tickets are usually sold through various distribution points such as internet, call center, retail outlets. Tickets for popular events can run out quickly as all sales channels access the same ticketing pool. In some cases, additional tickets may be offered for sale upon the decision of the Event Organizer before the event, but we do not have any control over this capacity or ticket availability, and we hereby additionally state that we cannot give any guarantee in this context. In addition, in some events, event organizers may update ticket prices later, increase or discount ticket prices, organize additional campaigns or turn the event into a free event. We hereby reiterate that Biletix has no responsibility in such cases, and the event organizer determines the event prices.

4. If you choose the "courier" option as the delivery method for your purchased tickets, please make sure that the address and the information of the person to take delivery are correct in order to avoid any problems with the delivery. The courier fee is charged to your credit card, provided that you are informed under the explanation "courier/cargo cost" at the stage of preliminary information and during ticket purchase; thus, no need for you to make payment to the courier/cargo. In case you provide an address other than the delivery regions, delivery cannot be made. Mail Order Request Form or Delivery Form can be signed during delivery.

5. Responsibility for controlling and keeping your tickets attributes to you. Note that the tickets may become unusable due to direct sunlight or heat damage and keep them in a safe place. Biletix is in no way responsible for lost, stolen or destroyed tickets. Please note that in this case, you cannot be given a new ticket and/or your ticket cannot be exchanged.

6. The Event Organizer may cancel/postpone or change the dates/venues of the events for various reasons. In this case, the organizer determines and announces the procedure to be applied. Biletix is not responsible for the cancellation/postponement of the event and/or changing the event date/venue, but the Organizer is responsible. In the event that an event is cancelled/postponed or the date/venue is changed, we will make reasonable efforts to notify ticket holders of such cancellation/postponement or change, provided that we obtain the necessary authorization from the Event Organizer. In case of cancellation or postponement of the event and/or change of date and venue, we, as the intermediary service provider, will inform you in writing and/or with a permanent data storage within three days from the date we learn of this situation. Therefore, please make sure that the contact information you provide/share with us is up-to-date and accurate and that your messages are not moved to the trash (SPAM) so that you can be informed about possible updates about the event ticket you have purchased. We state that we can only reach you in a limited way within the scope of your contact information that you share with us. In addition, it is your responsibility to check and read your messages, and Biletix is not responsible for your failure to check and/or not check your messages in due time. In addition, sports competitions may be canceled/postponed and/or their dates-venues may be changed for various reasons or based on judicial/administrative authority decisions. In this case, the procedure to be applied will be determined and announced by the relevant parties. Biletix is not responsible for the cancellation/postponement of the sports event and/or the change of the date-venue. In the event that a sports event is canceled/postponed or its date-venue is changed, we will make reasonable efforts to inform the ticket holders of such cancellation/postponement or change, provided that we obtain the necessary authorization from the relevant parties, and we will inform you of this situation in writing and/or with a permanent data storage. Therefore, please make sure that the contact information you provide/share with us is up-to-date and accurate and that your messages are not moved to the trash bin (SPAM) so that you can be informed about possible updates about the competition ticket you have purchased.

7. Except for the cancellation and/or postponement of the event and/or competition, all ticket sales are final. Pursuant to subparagraph (g) of Article 15 of the Regulation on Distance Contracts, which is titled "exceptions to the right of withdrawal", you do not have the right to withdraw from the event tickets you have purchased, as the contracts regarding accommodation, transportation of goods, car rental, food and beverage supply and leisure time for entertainment or recreation, which must be made on a certain date or period, are among the contracts that are among the exceptions to the right of withdrawal. In case of loss, theft, damage or destruction of the sold tickets in any way, no ticket replacement/new ticket printing or refund will be made. Without prejudice to the provision of Article 9, except for the cancellation/postponement of the Event/competition, the tickets sold are not canceled, changed or refunded in any way after the sale process. However, in cases where it is not possible for the ticket holder to attend the event/competition whose date or venue has been changed, a refund can be made to the ticket holders, provided that the refund procedures and periods are complied with. Refund amounts are limited to the refund of the ticket fee written on the purchased ticket, and it is not possible to claim/refund the service fee or any other fee. However, in case of cancellation or postponement of the event, the Event Organizer has the right to impose some limitations on the refund terms as well as the right to make changes in the program. In addition, in the event of cancellation or postponement of the event, the Organizer has the right to impose some restrictions on the refund conditions, as well as the right to make changes to the program without any obligation to refund or change the ticket. It is your responsibility to comply with the refund request deadlines and other instructions set by the organizer regarding refunds and to read/control the information we send to the contact information you have provided to us. Tickets and/or fees cannot be refunded outside the refund dates determined by the organizer. In this context, Biletix assumes no responsibility. You can find more information about cancelled or modified events on our website.

8. The tickets and/or the terms and conditions of the ticket purchase as well as the provisions of the agreement are arranged according to the rules of the venue and the Event Organizer. Breach of any of these Rules and Regulations or any unacceptable behavior likely to cause damage, nuisance or injury (including reasons of public safety, such as crowd surfing or moshing, or failure to comply with any measures put in place to combat the spread of Covid-19) shall entitle the venue or Event Organizer to eject you from the venue, and you shall not be entitled to a refund. In this case, we significantly emphasize that our Company shall not have any responsibility and any payment obligations, including the ticket price. The venue may on occasions have to conduct security searches to ensure the public safety. Additionally, certain organizers are entitled to refuse to sell tickets to the customers, whose personal data are not available on the system, for security purposes or other reasons. Nevertheless, availability of the identity information of the persons to enter the venue in the systems of the event organizer is necessary particularly for security purposes. Such cases are notified prior to the sale of the relevant event ticket. Therefore, if you do not want your personal information to be shared with the event organizer in such cases, you should carefully read the "Confidentiality Statement" and the explanations regarding personal data, which are an integral part of this contract, before completing the order and buying the ticket, as the event organizer has the right to refuse to sell you tickets. In such special cases, Biletix shall not be responsible if tickets cannot be sold to you because you do not want to share your personal information with the event organizer.

9. The exits and entries from/to the venue shall be conducted pursuant to the rules and regulations of the Event Organizer and the venue. In general if you go out from the venue after the ticket control, you cannot be re-admitted to the venue. If you are late to the event, depending on the rules and regulations set by the Event Organizer, you may not be allowed in at all or you may be admitted late to the event venue and these rules may differ according to the organizer. Biletix cannot guarantee admission of late comers and shall not responsible for the same in any way. Also, please note that if there are special rules and regulations determined by the Event Organizer and/or the event venue and announced to you in advance to enter the event venue, these rules have to be followed, otherwise you may not be admitted to the venue and tickets shall not be refunded. Therefore, at each ticket sale stage, please purchase the event ticket by reading the rules about the event, if any, given under the topic "Please Note". If you will not be able to fulfill the requirements given under the topic "Please Note", do not confirm your ticket purchase order.

10. Use of cameras, mobile phones or recording equipment is subject to rules and regulations set by the Event Organizer. Therefore, it may be prohibited to bring cameras or other recording equipment, laser pens and mobile phones into the venue.

11. The Event Organizer may prohibit pets and animals to be allowed into the venue, except for guiding dogs for the disabled.

12. The Event Organizer may prohibit entry of food and beverages brought by customers from outside into the venue. Biletix shall ​​not be responsible for the food and beverages sold at the event venue.

13. The venue, the Event Organizer and Biletix do not assume any responsibility for the personal belongings of the customers. Thus, please note that you are personally responsible for all your belongings at the event venue.

14. The ticket holder has the right to only one seat of the value written on the ticket, and the event venue or the Event Organizer reserves the right to assign a different place to the ticket holder than the place indicated on the ticket. Only the Organizer, but not Biletix, shall be responsible for such an assignment.

15. Biletix is ​​not under any other liability, undertaking or responsibility regarding the tickets/ticket sales and/or events/contents of the events, apart from the price written on the ticket and the related service fee. Therefore, you hereby agree and undertake in advance not to demand or claim any other fee against Biletix, under whatsoever, title such as travel expenses, accommodation expenses, parking-gasoline-transition expenses, etc., for any reason. You are considered to have agreed, acknowledged and undertaken in advance that Biletix's liability is limited to this article and that you shall not hold Biletix responsible under whatsoever title, except for the liability limit set forth in this article.

16. In case you intend to get information about the ticket purchase process, you can call Customer Services with the reference number we have given you when completing your transaction.

17. Our website has been prepared in Turkish and English. In case of any difference and/or contradiction between the texts, the Turkish text shall prevail.

18. Commercial electronic messages under the Agreement may be sent to you, provided that your prior consent is obtained. If you do not want to receive commercial electronic messages under the agreement, we remind you to remove the check mark in the "sending electronic message" section. You also have the right to refuse to receive commercial electronic messages at any time without any reason. On the other hand, we also point out that if you provide contact information for the purpose of contacting you, no separate consent shall be obtained for any changes in the services provided and/or commercial electronic messages for use.
In addition, it is legally possible to communicate for marketing, promotion and/or change services related to the same or similar services without your prior consent, if your contact information is obtained by informing you that such communication is to be made by giving you the opportunity to refuse during the provision of the relevant service.
However, you reserve the right to refuse such communication and to withdraw the permissions you have given in this context, and it is sufficient to transmit your request to us by any mean.

19. The text of this agreement is stored by Biletix data after conclusion of the contract, and you can easily access this agreement at "Our Policies" section of our website as of the revision dates. If you wish, you can easily access the hardcopy of the agreement by printing it out. Therefore, we would like you to know that you are enabled to easily get and store the provisions of the agreement and the general terms and conditions of the transaction. Your access in the agreement is allowed to continue in direct proportion with the access in our website.

20. The privacy rules regarding the use of our website and this agreement are detailed in the "Privacy Statement" section under the topic "Our Policies". In this context, we would like to inform you that you need to carefully read and review the terms of the Privacy Statement, and if you have different requests, you need to inform us. The Confidentiality Statement is an annex hereto and an integral part hereof and shall exactly be applicable and effective together with the Agreement. Therefore, we significantly reiterate that approving this Agreement and/or order, you shall also be deemed to have accepted the terms of the Privacy Statement.

21. All the terms of the agreement, including the total price you will pay, can clearly be displayed by you during confirmation of the order and before entry of the payment information. In addition, all the details of the service you purchased shall be notified to you before confirming the order. Therefore, buying the ticket and confirming the ticket purchase order, we reiterate once again that you shall be deemed to have accepted the terms of this agreement and shall be bound by the terms of the agreement, and that you should carefully examine all the contractual provisions before confirming the purchase order.

22. Biletix is ​​responsible for storage and security of personal data obtained about you. We also point out that your personal data cannot be transmitted to third parties without your consent and cannot be used for purposes other than those notified to you. In addition, we state that you can access all detailed information on protection and use of your personal data from the "Privacy Statement" and "Information on the Protection of Personal Data" section of our Site, in the "Our Policies" section, and we also reiterate that the Privacy Statement is an annex hereto and an integral part of thereof.

23. All of these terms and conditions are subject to the Turkish Law. Biletix has hereby informed all consumers about the provisions of the agreement and its content hereof beforehand and fulfilled the obligation of preliminary information, and we also state that buying the ticket and confirming the ticket purchase order, you shall be deemed to have accepted to have been informed about the contents of this agreement and the service you have purchased, and this article shall be considered a written conclusive evidence. In case of any dispute arising out of or in connection with this agreement and/or service or ticket purchases, it is our primary objective to first of all try to resolve the dispute amicably. However, in cases that cannot be resolved amicably, we would like to inform you that you, as consumers who purchase tickets from our website, can take your possible problems to the consumer arbitration committee or the consumer court with the condition of applying to the mediator before filing a lawsuit under Article 73/A of the Law within the monetary limits published in the relevant legislation.

1. What Information We Collect

Biletix gathers two basic types of information through the Site: "Personally Data" ("Personal Data") and "Non-Personal data" (or "Non-Personal Data"). As per Article 11 of the Personal Data Protection Law (“KVKK”), applying to Biletix and/or the representative to be announced by Biletix, the Users and Members shall be entitled to

· learn the purpose of processing personal data and whether they are used in accordance with its purpose,

· learn about the third parties to whom personal data is transferred in the country or abroad,

· request correction of personal data if it is incomplete or incorrectly processed,

· request deletion/destruction of personal data within the framework of the conditions stipulated in Article 7 of the e-KVKK,

· request notification of the transactions made in accordance with subparagraphs (d) and (e) above, to third parties to whom personal data has been transferred,

· object to the conclusion to come out against the person himself by analyzing the processed data exclusively through automated systems,

· request the compensation in case of loss due to unlawful processing of personal data,

2. How We Use the Information We Collect

We know it is very important to protect the information you share with us. We take appropriate security measures to help safeguard this information against unauthorized access and disclosure. We can access, obtain, use, process and/or transfer your personal information to/from the country only within the provisions of the legislation. a. Non-Personal Data

Since Non-Personal Information cannot personally identify you, we may use it for any legitimate purpose. For example, we may use it to measure visit hours, average time spent on our site and pages viewed, and to diagnose problems with our servers and to administer our site, analyze and improve our site's features and functionality. In addition, we reserve the right to share this non-personal information that does not personally identify you with third parties for any purpose. We may also share this information with third parties who are not part of the Biletix/Live Nation Entertainment family for use for advertising purposes or in aggregate or in other ways that will not disclose any of your Personal Information.

Explicit Consent for Personal and/or Private Personal Data:   Biletix customers, users of our website and/or persons who share other personal data, who purchase event tickets from our website, "tick" the "Confirmation Text within the Scope of the Personal Data Protection Law" published on our website. By the way so, they consent to the receipt, processing and transfer of their personal / or private personal data within the scope of the related laws and regulations.

In addition, with regard to the tickets purchased through our Call Centers, personal data is obtained, processed and transferred to/from the country, depending on the call center keying preferences of our customers for receipt, processing and transfer of their personal data.

In cases where the explicit consent of the person is required, it should strictly be taken into consideration that some features on the Site may be out of use, the service may not be offered partially or completely, in other words, ticket sale may not be made, unless the necessary consents/permissions are given in terms of personal data. Because, it should not be disregarded that certain personal data must be obtained, processed and transferred in order to purchase event tickets, with exceptions, where express consent is not required under the provisions of the legislation.Biletix does not accept any responsibility and cannot be held responsible for the failure to sell tickets due to the lack of necessary consent for provision, processing and/or transfer of personal data or the relevant personal data, without prejudice to the situations where express consent is not required within the scope of the legislation.

How can your Personal Data be processed? Your personal and/or sensitive personal data obtained upon your consent may partially or entirely be obtained, recorded, safeguarded, stored, changed, updated, periodically checked, rearranged, classified, retained for the period required for the purpose for which they are processed or stipulated in the relevant law, legal or service-related actual requirements, within the scope of your consent, in whole or in part by our Company, as Biletix, with the capacity of data controller, acting for and on behalf of our Company, through our retail sales channels, call centers, kiosks, affiliates or through our websites and social media pages and/or all kinds of channels; it may be shared/transferred with/to private-legal persons with whom our Company works together or with public institutions and organizations for which it is legally liable, and/or with/to relevant third parties, real persons/legal persons residing in Turkey or abroad, insurance companies, banks, legal or otherwise. It can be transferred or processed abroad , including preventing its use, in case of actual requirements depending on the service. In this regard, in accordance with the Law, your personal and/or private personal data that you share with our Company upon your consent will be able to be obtained, recorded, stored, preserved, changed, rearranged in whole or in part as well as subjected to all kinds of operations on data such as disclosure, transfer, takeover, making available, classification or prevention of use all by us by automatic or non-automatic means provided that it is a part of any data recording system.

How is your personal data collected? Your personal and/or private personal data can be collected verbally, in writing or electronically through all kinds of channels including but not limited to our website, our sales and marketing department employees, forms collected during customer visits, digital marketing and call center/website/ social media/organizers/business partners all based on your consent In addition, your personal data may be collected verbally, in writing or electronically, upon your consent, through channels such as the Head Office, retail outlets, kiosks, internet branch, social media and call center.

What would be the Situation of Your Data prior to the Publication of the Law? Pursuant to the provisions of the Law, “Your personal data processed before the publication date of this Law will be brought into compliance with the provisions of this Law within two years from the date of publication (07.04.2016). On the other hand, consents obtained in accordance with the law before the publication date of the Law are deemed to have been accepted in accordance with this Law, unless a contrary declaration of intent is made within one year”. We would like to point out that since becoming a member of Biletix and purchasing tickets, Biletix customers are deemed to have accepted the Terms of Use and Privacy Policy , and there are detailed regulations regarding delivery, processing and transfer of your personal and/or sensitive personal data in our Privacy Policies before the date of the publication of the Law, there exist your "lawful consent" given to us regarding your personal/or sensitive personal data that we have obtained and processed. Therefore, pursuant to the Law, these consents of yours, obtained in accordance with the law before the publication of this Law, are deemed to have been accepted in accordance with this Law, unless a statement of intent is made to the contrary within one year.

What are the purposes and legal reasons for the processing of your personal data? We will receive and process your personal and/or sensitive personal data that you share with us in accordance with the Personal Data Protection Law No. 6698 and the relevant legislation first of all to be able to sell, market and distribute the event tickets requested by our customers from Biletix, to perform the services we provide to our customers in accordance with the requirements of the contract and technology, and to improve the products and services we offer to you.

In addition, the purposes and reasons for processing of your personal data are to be able to sell event tickets, to use the same in all kinds of products and services, including those that we can offer as an agency within the scope of the legislation; to identify the information of the transaction owner and to record the identity, address and other necessary information so that we can provide the service provided with our customers by Biletix; to arrange all records and documents to constitute the basis of the transaction in electronic medium or print-out; to fulfill the requirements such as keeping information, reporting, informing, etc. required by the legislation and by the competent authorities; to be able to provide the requested products/services and to fulfill the requirements of the service you request and required by the contract as well as the reasons in its content.

Details of purposes for using and processing your personal data are briefly given as follows:

i. Site: We may use your Personal Data you give us to better tailor your website experience to your interests, to show you content in which you may be interested and to display the content according to your preferences.

ii. Communications: We may use your Personal Information to inform you about Biletix and its services and promotions on behalf of some of our partners, upon your consent within the scope of the relevant legislation.

On the other hand, it is possible to process personal data without seeking the explicit consent of the data subject in accordance with the legislation , in any of the cases where "it is necessary to process the personal data of the parties to the contract, provided that it is directly related to establishment or performance of a contract" , "Data processing is mandatory for establishment, exercise or protection of a right", "It is mandatory for the data controller to fulfill its legal obligation ”, “it has been made public by the person concerned”, “It is mandatory to process data for the legitimate interests of the data controller, provided that it does not prejudice the fundamental rights and freedoms of the data subject”, “ıt is mandatory for the protection of another person's life or physical integrity for the person who is unable to express his/her consent due to actual impossibility or whose consent is not legally valid” or "it is explicitly stipulated by the laws".

v. For Specific Operating Purposes: We may also use your Personal Information upon your consent for ad targeting, data analytics, audits, fraud prevention and other internal business purposes.

vi. Shopping/Commercial Services: When you make a purchase through the Site, we may collect your credit card number, billing address and other information related to such purchase (collectively, "Payment Information") from you. We will use the Payment Information that you provide to bill you for your purchase and to complete your purchase. Providing your Payment Information, you thereby authorize us to give that information to third parties as necessary to confirm and fulfill your order (for example, to process your credit card number and to send you products you have ordered).

Information on persons or legal entities to which we possibly send your personal data:   For the above-mentioned purposes, the persons/organizations to which your personal and/or private data that you shared with us can be transferred upon your consent; to primarily our main shareholder, Ticketmaster A.Ş. and its direct/indirect domestic/foreign affiliates; program-service partner individuals and organizations, banks, courier-cargo companies that deliver your tickets to your address, and other relevant 3rd parties, from which we receive services / cooperate with to carry out our activities. In this context, we would like to point out that since our Company acts as an intermediary for the sale and distribution of event tickets of the organizers it works with, the necessary personal and/or private personal data about you is collected within the scope of the provisions of the legislation and in accordance with the necessity, transmitted to the event organizers, banks and/or other relevant third parties (including but not limited to car rental companies, insurance companies, courier/cargo companies and persons and organizations related to the service provided) acc to the scope of the requested service and/or transferred in the country and/or abroad.

a. Affiliate Communications:  Commercial electronic transmissions under the agreement may be sent to you; provided that your prior consent is obtained. As this consent is possible to be obtained in writing or through any and all communication devices, if you do not intend delivery of commercial electronic transmissions under the agreement, we remind you that you are required to uncheck your consent in the section of “delivery of electronic transmission” Additionally, you have the right to refuse commercial electronic transmissions at any time and without any reason. Nevertheless, we hereby warn you that in case you provide your contact details to allow communication with you, no additional consent shall be required for commercial electronic transmissions for any changes relating to the services offered and/or for use.

Furthermore, at the time of offering the service, in case your contact details are obtained after having informed such a communication is to be made and letting you refuse this communication, it is possible to enable communication for the marketing, promotion and/or change services relating to the same or similar services without obtaining a new consent from you. Besides, your right to refuse such a communication and withdraw permissions you have given hereunder is reserved and it is sufficient that you communicate such a request in any way. Biletix Service Providers:  We work with third parties who provide services including but not limited to data analysis, order fulfillment, credit card processing and other services of an administrative nature. If you use our services , within your confirmation we reserve the right to share your Personal Data with such third parties for the purpose of enabling these third parties to provide such services within your consent and to the extent required. Opt-In Policy

a. Biletix Communications: When you supply Biletix with your contact details, from time-to-time, in Biletix's discretion, you may be asked to indicate whether you are interested in receiving information from us about special offers in connection with the Site, Biletix and/or our advertisers and partners.

If you do choose to opt-in to receive such communications, we may, from time to time, send you marketing communications. We hereby remind you that you are unilaterally entitled to renounce from receiving such communications at any time
At any time, you can choose to no longer receive weekly commercial or promotional emails from us by clicking on My Account and following the instructions to "manage your email alerts." Siteyi/ uygulamayı başka bir siteye bağlanmak amacıyla ya da siteye/ uygulamaya içerik veya başka bilgiler yüklemek amacıyla kullanmanız da dahil, siteyi/ uygulamayı haksız/hukuka aykırı kullanmanızdan dolayı üçüncü şahısların maruz kalabileceği zarar ve ziyanları tazmin edeceğinizi de kabul etmektesiniz., Siteyi/ uygulamayı kullanırken, ilgili mevzuat hükümlerine uyacağınızı faaliyetleriniz ile ilgili olarak mevzuat hükümlerine uymamanız nedeni ile gerek Biletix ve gerekse de 3. kişiler nezdinde doğacak her türlü sorumluluğun bizzat kendinizeait olacağını, bu sorumluluklar nedeni ile Biletix’ten rücuen herhangi bir talepte bulunmayacağınızı, keza bu madde kapsamında Biletix’e yönelebilecek olası talepleri ve zararları derhal tazmin edeceğinizi beyan, kabul ve taahhüt etmektesiniz.
6- Biletix, sitenin/ uygulamanın kesintisiz veya hatasız olacağını ya da sitenin/ uygulamanın veya içeriğinin kullanılmasıyla ya da siteye/ uygulamaya bağlantı yapılmasıyla belirli sonuçların elde edileceğini garanti ve taahhüt etmez. Yine, Biletix, sitede/ uygulamada sunduğu hizmetler kapsamında kullanıcılara belirli bir amaca uygunluk, kesintisiz devamlılık, güncelleme, işlevsellik, doğruluk, hatasızlık dahil, açık ya da zımni hiçbir garanti ve/veya vaad vermemektedir. Site/ uygulamave içeriği "olduğu gibi" ve "mevcut haliyle" esasında sunulmaktadır. Biletix, siteden/ uygulamadan yüklediğiniz dosyalarda virüs ya da kirletici veya bozucu özellikler bulunmadığını da garanti etmemektedir. Biletix, sitenin/ uygulamanın belirli bir amaca uygunluğu ve ticari değerine ilişkin garantiler de dahil olmak üzere her türlü başka aleni veya zımni garantiyi de üstlenmemektedir. Biletix sitenin/ uygulamanın kullanılmasından kaynaklanabilecek zararlar için hiç bir şekil ve surette sorumlu tutulamaz. Biletix, sitenin/ uygulamanın kullanılmasından ya da Biletix hizmetinin kullanılmasından beklenebilecek sonuçlar konusunda hiç bir garanti vermez.
7- Biletix; sitenin/ uygulamanın üçüncü şahıs kullanıcıları, Biletix kullanıcıları, reklamcıları ve/veya sponsorlarının işlem ve fiillerinden dolayı sorumlu olmadığı gibi, sizlerin de siteyi/ uygulamayı ve/veya Biletix hizmetini kullanmanızla ilgili fiil, ihmal ve davranışlarızdan dolayı hiç bir şekilde sorumlu değildir. Biletix; herhangi bir etkinliği organize eden kişiler, icracılar, kurumlar veya başka üçüncü şahısların siteyle/ uygulamayla bağlantılı veya siteye/ uygulamaya atıfta bulunan ürünleri, hizmetleri, fiil veya ihmalleri nedeniyle de sorumlu tutulamaz.
8- Biletix'in sorumluluğunu sınırlayan hükümlerden herhangi birinin ilgili mahkeme tarafından ilgili mevzuata aykırı bulunması halinde, söz konusu hüküm mevzuata uygun olan ve sorumluluğu en aza indiren mevzuat hükmü kapsamında uygulanacak ve Biletix'in sorumluluğu buna göre belirlenecektir.
9- Biletix, Site'de/ uygulamada sunulan Hizmet'leri ve içerikleri her zaman değiştirebilme; Siteye/ uygulamaya “blog” koyma, Kullanıcı'ların sisteme yükledikleri bilgileri ve içerikleri, Kullanıcı'lar da dahil olmak üzere, üçüncü kişilerin erişimine kapatabilme ve silme hakkını haizdir. Biletix, bu hakkını, hiç bir bildirimde bulunmadan ve önel vermeden kullanabilir.
10- Biletix, Site/ uygulama üzerinden, Biletix’in kendi kontrolünde olmayan üçüncü kişilere ve başkaca üçüncü kişilerin sahip olduğu ve işlettiği başka web sitelerine ve/veya portallara, dosyalara veya içeriklere 'link' verebilir, yönlendirme yapabilir. Bu 'link'ler/yönlendirmeler, web sitesini veya siteyi işleten kişinin desteklendiği ya da web sitesi veya içerdiği bilgilere yönelik herhangi bir türde bir beyan veya garanti niteliği taşımamaktadır. Site/ uygulama üzerindeki 'link'ler vasıtasıyla erişilen portallar, web siteleri, dosyalar ve içerikler, bu 'link'ler vasıtasıyla erişilen portallar veya web sitelerinde sunulan hizmetler veya ürünler veya bunların içeriği hakkında Biletix’in herhangi bir sorumluluğu ve/veya taahhüdü yoktur.
11- Biletix, gerekli gördüğü zamanlarda site/ uygulama kapsamındaki hizmetleri/siteyi geçici bir süre ile askıya alabilir veya tamamen durdurabilir. Hizmetlerin geçici bir süre askıya alınması veya tamamen durdurulmasından ya da sitenin/ uygulamanın kapatılmasından dolayı Biletix’in kullanıcılara karşı herhangi bir sorumluluğu bulunmamaktadır.
12- İşbu Kullanım Koşulları, Biletix Satış Politikası ı ve Satış Sözleşmesi ile Gizlilik Beyanını da kapsamakta olup, sitemizi/ uygulamamızı ziyaret edenler ve siteyi/ uygulamayı kullananlar, söz konusu Satış Politikası ve Satış Sözleşmesi ile Gizlilik Beyanı hükümlerini de okuduklarını, bunları kabul ettiklerini ve anılan Politika içeriklerine ve Sözleşme hükümlerine riayet edeceklerini kabul, beyan ve taahhüt etmişlerdir.
13- Siteyi/ uygulamayı kullanmakla, site/ uygulama hakkında veya site/ uygulama ile ilgili bir ihtilâfın çıkması halinde, bu ihtilâfın kanunlar ihtilâfı kurallarına bakılmaksızın Türkiye Cumhuriyeti kanunlarına tâbi olacağını ve bu kanunlara göre çözümleneceğini kabul etmiş sayılıyorsunuz. Ayrıca, siteye/ uygulamaya ve/veya hükümlerine ilişkin herhangi bir ihtilafın doğması durumunda İstanbul (Çağlayan) mahkemelerinin ve icra dairelerinin görevli ve yetkili olacağını da kabul etmektesiniz.
14- Bu Kullanım Koşullarını ihlâl ettiğiniz takdirde, Biletix Siteyi/ uygulamayı kullanmanıza son verebilir, gelecekte Siteyi/ uygulamayı kullanmanıza engel olabilir ve/veya aleyhinize ilgili yasal yollara müracaat edebilir.

Our Company named "Biletix Bilet Dağıtım Basım ve Ticaret A.Ş.” (“Biletix”), as an authorized ticket sales agency, acts as an intermediary for sales and distribution of the event tickets of the “organizers, event venues, clubs or theaters” (hereinafter referred to as the “Event Organizer”). Our goal as “Biletix Bilet Basım Tic. A.Ş.” is to make your purchasing experience easy, efficient and equitable. We would like to provide you with preliminary information as per the provisions of the Distance Contracts Regulation and other related laws and legislation and fulfill our obligations regarding preliminary information, before you purchase the ticket of the event you prefer/demand and establishment of the sales agreement and confirm your order in this context:

a. The service subject matter of your ticket purchase order and the agreement is event ticket sales service. As an authorized ticket sales agency, Biletix acts as intermediary for the sale and distribution of event tickets for Event Organizers. Our company Biletix does not act for on behalf of the event organizers, and does not have any legal/commercial relationship with the organizers under any whatsoever title, within the scope of any dealership, distributorship, representation, sub-dealership, etc. Event ticket sales are covered by the agreements for the use of leisure time for entertainment or recreation, required to be held on a certain date. Biletix has no right, authority or responsibility regarding the content of the events. The event organizer decides the content of the event you prefer to purchase and all the rules regarding the relevant event. We hereby reiterate that Biletix only assumes and undertakes a limited role as an intermediary for the sale and distribution of the event tickets.

b. As our company acts as an intermediary for the sales and distribution of the tickets of the event organizers, the vendor or provider information may differ for each event. In this context, it is possible for you to see the vendor and provider information in the event organizer information section of the event tickets page you prefer/plan to purchase. Through the same section, it is also possible to access in the full address, telephone number and similar contact information that allows you to quickly contact the event organizer or submit your complaints. c. The total price of the event ticket and service you plan to purchase, including all taxes, the service fee, the details of delivery costs and other additional costs, if any, as well as all information about the event, conditions of participation, if any, delivery methods of the event tickets, shall be displayed on the page of the event ticket you plan to purchase, each specific for the relevant event. Biletix charges a service fee per ticket, but does not have the right or authority to determine the event content, ticket prices or seating. Your ticket purchase is subject to (i) the special terms and conditions disclosed and announced to be applicable to the event, (ii) all other terms and conditions of the event determined and announced by the event organizer(s) and/or the event's announced terms and conditions, and (iii) the event venue terms and conditions, if announced by the event organizer ( including entry requirements) by the way so. Therefore, by purchasing a ticket, you thereby agree that you shall abide by all the terms and conditions determined and announced for the event. If you do not agree with any of the terms and conditions of the event set and disclosed, or if you cannot and/or will not comply with any of these terms and conditions, you should not purchase a ticket. Otherwise, even if you have purchased a ticket, we significantly emphasize that Biletix shall not be responsible for your absence from or removal from the event venue and/or event, and Biletix shall not be liable for any payment, including the ticket price. We would like you to know that before confirming the order and executing the sales agreement, all details and information about the event and service you intend to purchase are communicated to you in details. In case you have any doubt or hesitation about the event terms and/or content, we strongly point out that you should contact us before confirming the order or that you should not confirm the order. Having confirmed your ticket purchase order, you hereby and thereby agree, acknowledge and undertake in writing - before purchasing the ticket - that you are aware of all the following information: a) all the necessary information and contact addresses about our company, b) all the features of the ticket and service you have purchased, as well as the total ticket/service price including all taxes, and all additional costs, if any, c) information on payment, delivery, performance and legal remedies relating to the complaints set forth in the agreement, d) the contractual information that you can apply to the consumer arbitration committee within the monetary limits published in the relevant legislation or to the consumer court with the condition of applying to the mediator before filing a lawsuit in accordance with Article 73/A of the Law, e) you do not have the right of withdrawal as per Article 15(g) of the Distance Contracts Regulation; consequently, you are aware of all the terms and conditions set forth under the Agreement.

d. In case of any dispute arising out of or in connection with service or ticket purchase transactions, it is our main objective to try to first resolve the dispute amicably. However, in cases that cannot be resolved amicably, we would like you to know that you, as consumers who purchase tickets from our site, can take your potential issues to the consumer arbitration committee within the monetarylimits published in the relevant legislation or to the consumer court with the condition of applyingto the mediator before filing a lawsuit under Article 73/A of the Law.

e. Pursuant to subparagraph (g) of Article 15 of the Distance Contracts Regulation, titled "Exceptions to the Right of Withdrawal"; since the agreements executed to spend leisure time for the purposes of accommodation, transportation of goods, car rental, food and beverage supply and entertainment or recreation, required to be held on a certain date or within a certain period, are among the exceptions to the right of withdrawal; and since the sales of event tickets are among the agreements executed to spend leisure time for the purposes of entertainment or recreation, required to be held on a certain date, you do not have the right of withdrawal according to the relevant regulation, therefore, we strongly remind you that before confirming the order and purchasing the ticket, you are required to complete the sales process, being aware of that you have no right of withdrawal.

f. Furthermore, we also state that we have drafted and prepared our Sales Policy and Sales Agreement to the extent that it would satisfy you as a customer and inform you about the purchasing process on Biletix.com. Our Sales Policy and Agreement also constitute a part of our Terms and Conditions. We also kindly submit for your information that purchasing tickets, you shall be deemed to have read and understood the Terms of Use, Sales Policy and the provisions of the Agreement as well as the Privacy Statement, and you shall be deemed to have accepted their contents; in case you have an otherwise demand or complaint against the provisions of the sales policy and/or the sales agreement, we recommend that you visit the Help page and/or contact us at the contact numbers listed above and/or on our site before confirming your purchase order. Meşru menfaat (Kanun madde 5/2-f): Bilgi ve işlem güvenliğinin sağlanması, işlem bilgilerinin tespiti, hizmet kalitesinin arttırılmasına yönelik analiz ve raporlama faaliyetleri (temel haklara zarar vermemek kaydıyla).

Açık rıza (Kanun madde 5/1): Açık rıza verilmesi halinde kampanya, tanıtım ve pazarlama faaliyetlerinin yürütülmesi, ticari elektronik ileti gönderimi

amaçlarıyla ve yukarıda belirtilen hukuki sebepler dahilinde işlenebilmektedir:

4. Kişisel Verilerin İşlenme Yöntemi: Kişisel verileriniz;

• İnternet sitesi ve mobil uygulamalar üzerinden elektronik,

• Çağrı merkezi ve e-posta yoluyla elektronik,

• Yazılı başvurular ve resmi tebligatlar aracılığıyla fiziki ortamda, otomatik veya otomatik olmayan yöntemlerle

toplanmakta, mevzuat hükümleri kapsamında otomatik veya otomatik olmayan yöntemlerle işlenebilmektedir.

5. Kişisel Verilerin Aktarılması: Kişisel verileriniz, Kanun’un 8. maddesinde öngörülen haller dışında açık rızanız olmaksızın üçüncü kişilere aktarılmamaktadır. Kanun’un 8. maddesi uyarınca, kişisel verileriniz; yurt içinde, Şirketimiz tarafından “Kanunlarda açıkça öngörülmesi, Şirketimizin hukuki yükümlülüklerinin yerine getirebilmesi için zorunlu olması, bir sözleşmenin kurulması veya ifası için gerekli olması, ​​bir hakkın tesisi, kullanılması veya korunması için veri işlemenin zorunlu olması ve/veya Şirketimizin meşru menfaati için zorunlu olması” hukuki sebeplerine dayanılarak, ayrı bir açık rızaya gerek olmaksızın üçüncü kişilerle paylaşılabilmektedir. • bilet satın alırken sigorta seçimi yapmış iseniz ilgili sigorta şirketine ve aracı kurumlarına,

• spor müsabası bileti satın almış iseniz 6222 sayılı Kanun gereğince ev sahibi Spor Kulübüne, ev sahibi olmayan müsabakalarda müsabakaya katılan her iki kulübe; milli müsabakalarda ise ilgili federasyona,

• kombine üyelik ve sadakat programı üyeliği gibi özel bir üyelik satın almış iseniz, ilgili spor kulüplerine ve program üyesi olan ilgili vakıflara/firmalara,

• bilet satın alırken bağış seçimi yapmış iseniz ilgili bağış kurumuna,

• şikayetlerinizin giderilmesi, size daha iyi bir hizmet sunabilmemiz ve de yasal- akdi yükümlülüklerimizi yerine getirebilmemiz için bilgi teknolojileri ve altyapı hizmet sağlayıcılarına,

• faturalama işlemleri kapsamında ilgili kurum/kuruluş ve alt yapı sağlayıcılarına,

• işlem güvenliği ve işlem kayıtlarının yedeklenmesi/arşivlenmesi için sunucu barındırma, arşivleme, depolama ve yazılım hizmeti sağlayıcılarına,

• yasal yükümlülüklerimizin ifası için yetkili kişilere/ adli- idari birimlere,

• Açık rızanızın bulunması halinde pazarlama ve reklam iş ortaklarına,

• Gerekmesi durumunda hukuki ve mali danışmanlar gibi bu bilgilere meşru iş amaçlarıyla erişimi gereken ilgili kişilere

aktarılabilmektedir. Şirketimiz tarafından kişisel verilerinizin yurt dışına aktarılması hallerinde ise, Kanun’un 9. maddesinde ve de Ki̇şi̇sel Veri̇leri̇n Yurt Dışına Aktarılmasına İli̇şki̇n Usul ve Esaslar Hakkinda Yönetmeli̇k’te düzenlenen “Standart sözleşmeyle uygun güvencenin sağlanması veya arızi olmak kaydıyla Kanun’un 9.maddesinin 6. fıkrasında düzenlenen hallerden birinin varlığı” hukuki sebeplerine dayanılarak aşağıda belirtilen alıcı grupları ile veri paylaşımı yapılabilmektedir:

• şikayetlerinizin giderilmesi, size daha iyi bir hizmet sunabilmemiz ve de yasal- akdi yükümlülüklerimizi yerine getirebilmemiz için bilgi teknolojileri ve altyapı hizmet sağlayıcılarına,

• işlem güvenliği ve işlem kayıtlarının yedeklenmesi/arşivlenmesi için sunucu barındırma, arşivleme, bulut alt yapı, depolama ve yazılım hizmeti sağlayıcılarına,

• koruma bedeli ödeyerek bilet satın almış iseniz yurt dışında mukim iadeli bilet sürecini yöneten firmaya,

Yurt dışına veri aktarımı yapılması halinde KVKK’nın 9. maddesi hükümlerine uygunluk sağlanmaktadır. Kişisel verileriniz bu maddede belirtilen üçüncü kişilere aktarılırken sadece gerektiği kadarı ile ve ilgisi kapsamında bir aktarım yapılacak ve ilgili mevzuat hükümlerine riayet edilecektir.

6. Kişisel Verilerin Saklama Süresi: Kişisel verileriniz; ilgili mevzuatta öngörülen saklama süreleri boyunca ve işleme amacının gerektirdiği süre ile sınırlı olarak saklanmakta, sürenin sona ermesi halinde silinmekte, yok edilmekte veya anonim hale getirilmektedir.

7. Kişisel Verilerinizin Korunması: Şirketimiz ile paylaşılan kişisel veriler, Şirket gözetimi ve kontrolü altındadır. Şirketimiz, yürürlükteki ilgili mevzuat hükümleri gereğince bilginin gizliliğinin ve bütünlüğünün korunması amacıyla gerekli organizasyonu kurmak ve teknik önlemleri almak ve uyarlamak konusunda veri sorumlusu sıfatıyla sorumluluğu üstlenmiştir. Bu konudaki yükümlülüğümüzün bilincinde olarak;

• Veri gizliliğini konu alan uluslararası ve ulusal teknik standartlara uygun surette periyodik aralıklarda sızma testleri yaptırılmaktadır.

• Web sitesi, mobil site ve mobil uygulama aracılığıyla Şirketimize ilettiğiniz kişisel verileriniz SSL (Secure Sockets Layer) teknolojisi kullanılarak korunmaktadır.

• Kişisel veri işleme faaliyetlerine ilişkin düzenli olarak risk analizleri yapılmakta ve risklerin azaltılması için aksiyonlar alınmaktadır.

• Kişisel verilere yetkisiz erişimleri engellemek için erişim ve yetki kontrolleri uygulanmaktadır.

• Veri işleme politikaları düzenli aralıklarla güncellenmektedir.

8. Kanun Kapsamındaki Haklarınız: Kanun madde 11 gereğince;

a) Kişisel verilerinizin işlenip işlenmediğini öğrenme,

b) Kişisel verileriniz işlenmişse buna ilişkin bilgi talep etme,

c) Kişisel verilerinizin işlenme amacını ve amacına uygun kullanılıp kullanılmadığını öğrenme,

ç) Kişisel verilerinizin yurt içinde veya yurt dışında aktarıldığı üçüncü kişileri bilme,

d) Kişisel verilerinizin eksik veya yanlış işlenmiş ise düzeltilmesini isteme,

e) Kanun’un 7. maddesinde öngörülen şartlar çerçevesinde kişisel verilerinizin silinmesini veya yok edilmesini isteme,

f) d) ve (e) bentleri uyarınca yapılan işlemlerin, kişisel verilerin aktarıldığı üçüncü kişilere bildirilmesini isteme,

g) İşlenen verilerin münhasıran otomatik sistemler vasıtasıyla analiz edilmesi suretiyle kişinin kendisi aleyhine bir sonucun ortaya çıkmasına itiraz etme ve

ğ) Kişisel verilerinizin kanuna aykırı olarak işlenmesi sebebiyle zarara uğramanız hâlinde zararın giderilmesini talep etme

haklarına sahipsiniz. Kişisel verilerle ilgili soru, hak ve taleplerinizi; Şirketimizin giriş kısmında belirtilen iletişim kanalları üzerinden Veri Sorumlusuna Başvuru Usul ve Esasları hakkında Tebliğ'de belirtilen şartlara uygun şekilde düzenlenmiş bir dilekçeyle ve/ veya ____ başvuru formunu doldurarak Şirketimize iletebilirsiniz. Talebin iletimi konusunda Kurulun başkaca yöntemler belirlemesi durumunda söz konusu yöntemlerle de talebinizi iletebilirsiniz. Şirketimiz, başvuruda yer alan taleplerinizi, talebin niteliğine göre en kısa sürede ve en geç otuz gün içinde ücretsiz olarak sonuçlandıracaktır. Ancak, işlemin ayrıca bir maliyet gerektirmesi hâlinde, Kurulca belirlenen tarifedeki ücret alınabilir.

Şirketimiz işbu Kişisel Verilerin Korunmasına İlişkin Aydınlatma Metni’ni yürürlükteki mevzuatta yapılabilecek değişiklikler çerçevesinde her zaman güncelleme hakkını saklı tutmaktadır.
